1. Acceptance of Terms and Conditions
These Terms of Service ("Terms") constitute a legally binding agreement between you and Safari Options (Pty) Ltd ("Company," "we," "us," "our"), a South African registered company. By accessing, browsing, or using our website, mobile applications, affiliate platform, and services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and POPI Act Compliance Statement. If you do not agree to these Terms, you must discontinue use of the Platform immediately. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of such modifications.
2. User Eligibility and Responsibilities
You warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding agreement. Users are responsible for maintaining the confidentiality of account credentials and for all activity that occurs under their account. You agree to provide accurate, current, and complete information during registration and to promptly update such information. You are solely responsible for all charges and liabilities incurred through your account. You agree not to use the Platform for any illegal, fraudulent, or harmful purposes, including but not limited to money laundering, fraud, harassment, or violation of intellectual property rights.
3. Affiliate Program Terms
For users participating in our affiliate program, the following additional terms apply:
- Verification and Compliance: All affiliates must complete identity verification and comply with South African legal requirements before receiving payments. We reserve the right to suspend accounts pending verification.
- Payment Terms: Affiliate commissions are calculated and charged monthly or upon reaching maximum budget limits. Your payment method must be verified and active. We are not responsible for billing errors resulting from incorrect information you provide.
- Budget Controls: You may set monthly spending limits, but cannot reduce your budget below the amount currently owed for unpaid commissions.
- Listing Content: You warrant that all content, descriptions, pricing, and images provided are accurate, lawful, and do not infringe on third-party rights. You indemnify Safari Options against any claims arising from your content.
- Commission Disputes: Commission disputes must be raised within 30 days of the transaction. After this period, disputes may not be considered.
- Suspension and Termination: We reserve the right to suspend or terminate your affiliate account for non-compliance, fraudulent activity, misrepresentation, or violation of these Terms.
4. Third-Party Service Providers and Limitation of Liability
Safari Options acts as a marketplace platform connecting travelers with third-party service providers including tour operators, accommodation providers, travel agencies, and guides. Safari Options, its staff, management, owners, shareholders, stakeholders, and affiliated entities are not liable for:
- Any information, listings, descriptions, pricing, availability, or quality of services provided by third-party service providers
- Any breach of contract, misrepresentation, fraud, negligence, or misconduct by third parties
- Any injuries, damages, losses, or harm arising from services provided by third parties, including but not limited to accidents, illness, theft, or property damage during travel
- Any failure of third parties to meet agreed-upon standards, fulfill bookings, or deliver promised services
- Cancellations, changes, or modifications made by third-party providers
- Travel disruptions including flight cancellations, weather events, immigration issues, or force majeure events
- Disputes over refunds, rescheduling, or compensation between users and third-party providers
- Unauthorized charges or billing disputes initiated by third parties
- Content, advice, or recommendations provided by third-party service providers
Users acknowledge and agree that they are entering into transactions directly with third-party service providers and assume all associated risks. Safari Options makes no warranties regarding third-party services and is not responsible for investigating the legitimacy or competence of service providers.
5. Booking, Payments, and Cancellations
- Booking Confirmation: Bookings are subject to availability and confirmation by the third-party service provider. Safari Options does not guarantee availability or secure bookings.
- Payment Processing: Payments are processed through authorized payment gateways. You authorize us to charge your selected payment method. Payment information is handled in compliance with PCI-DSS standards.
- Cancellation Policies: Cancellation policies are determined by individual service providers. Safari Options is not responsible for enforcing, modifying, or refunding based on provider policies. Contact the service provider directly for cancellation inquiries.
- Liability: Safari Options is not liable for payment processing errors, failed transactions, or disputes between users and payment processors. Such matters must be resolved directly with your financial institution or payment provider.
- Pricing: Safari Options does not control pricing set by third-party providers. Price accuracy is the responsibility of the service provider.
6. Intellectual Property Rights
All content on the Platform, including text, graphics, logos, images, software, and compilation thereof, is the property of Safari Options or its licensors and is protected by South African and international copyright and intellectual property laws. You may not reproduce, distribute, transmit, display, or perform any content without our prior written consent. Unauthorized use may result in legal action.
7. Prohibited Activities
You agree not to:
- Violate any applicable South African or international laws and regulations
- Engage in fraud, deception, or misrepresentation
- Post false, defamatory, or misleading information
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Transmit viruses, malware, or any harmful code
- Engage in harassment, abuse, or threatening behavior toward users or staff
- Scrape, crawl, or extract data without authorization
- Reverse engineer or attempt to extract the Platform's source code
- Use automated systems to create multiple accounts or manipulate listings
- Post content that violates intellectual property rights or contains explicit material
8. Disclaimers and Warranties
The Platform and all content are provided "as is" and "as available" without warranties of any kind. Safari Options disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that defects will be corrected. Your use of the Platform is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by law, in no event shall Safari Options, its management, staff, shareholders, stakeholders, or affiliated entities be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, or business interruption, arising from or related to your use of the Platform, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to Safari Options in the 12 months preceding the claim. Some jurisdictions do not permit limitations on liability, so these limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Safari Options, its management, owners, staff, shareholders, stakeholders, and affiliated entities from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your content or information you provide; (d) your dealings with third-party service providers; or (e) any illegal or unauthorized use of your account.
11. Travel Risks and Safety
Travel involves inherent risks including but not limited to accident, illness, injury, theft, loss, and death. Safari Options assumes no responsibility for travel safety or medical conditions. We recommend that all travelers obtain comprehensive travel insurance before booking. You are responsible for ensuring you have appropriate vaccinations, visas, travel documents, and understanding destination-specific risks. Check current travel advisories from the South African Department of International Relations and Cooperation and your home country's travel authority before booking.
12. Data Protection and POPI Compliance
Your use of the Platform is subject to our Privacy Policy and POPI Act Compliance Statement. We collect, process, and store personal information in accordance with the Protection of Personal Information Act (POPI), 2013. By using the Platform, you consent to such collection and processing. 13. User-Generated Content
Any reviews, comments, or information you post on the Platform ("User Content") remains your property, but you grant Safari Options a worldwide, royalty-free license to use, reproduce, modify, and distribute such content. You represent and warrant that your User Content is original, accurate, does not infringe third-party rights, and complies with all applicable laws. You are solely responsible for the consequences of posting User Content. Safari Options reserves the right to remove or modify User Content that violates these Terms or is otherwise inappropriate.
14. External Links and Third-Party Content
The Platform may contain links to third-party websites and services. Safari Options does not control these external sites and is not responsible for their content, accuracy, privacy practices, or compliance with applicable laws. Your use of third-party sites is at your own risk and subject to their terms and policies. We recommend reviewing third-party privacy policies and terms before engaging with external content or services.
15. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa. You consent to the jurisdiction and venue of these courts and waive any right to challenge jurisdiction. If any provision of these Terms is found unlawful or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
16. Modification and Termination
Safari Options reserves the right to modify these Terms at any time without prior notice. Your continued use of the Platform following any modification constitutes acceptance of the updated Terms. Safari Options also reserves the right to suspend or terminate your account and restrict access to the Platform for non-compliance with these Terms, violation of applicable laws, or engagement in harmful activity. Termination does not relieve you of your payment obligations.
17. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The failure of Safari Options to enforce any right or provision does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Safari Options.
18. Competition and Charitable Donation Terms
The following terms govern all competitions, prize draws, and charitable donation campaigns run by Safari Options (Pty) Ltd ("the Company") via the Safari Options platform, including but not limited to the "Giving Back" initiative.
- Eligibility: Competitions are open to South African residents aged 18 years and older only, unless otherwise stated. The Company reserves the right to verify eligibility and disqualify any entrant who does not meet the eligibility criteria.
- Entry: Entry is obtained solely by making a qualifying charitable donation via the PayFast payment gateway on the Safari Options platform. The number of entries is determined by the donation tier selected at the time of payment. No other method of entry is valid. No purchase of goods or services is required other than the charitable donation.
- No Cash Alternative: Prizes are non-transferable and no cash alternative will be offered under any circumstances. The Company reserves the right to substitute a prize of equal or greater value at its sole discretion, without prior notice.
- Winner Selection: Winners will be selected by random draw from all valid entries received by the stated closing date. The draw will be conducted by an independent third party or a designated representative of the Company. The Company's decision is final and no correspondence will be entered into.
- Notification: Winners will be contacted via the email address provided at the time of donation. If a winner cannot be contacted within 14 days of the draw, the Company reserves the right to select an alternative winner. The Company is not responsible for any failure to receive notification due to incorrect contact details, spam filters, or technical issues.
- Prize Conditions: Prizes are subject to availability, third-party supplier terms and conditions, blackout dates, and booking restrictions. The Company does not guarantee the availability of specific dates and is not responsible for any loss, damage, injury, or inconvenience arising from the use of the prize. Travel insurance is the sole responsibility of the winner.
- Charitable Proceeds: A portion of each donation is directed to the Company's designated charity partner. The Company does not guarantee a specific percentage allocation and reserves the right to adjust the allocation at its discretion. The Company does not provide tax receipts for donations unless specifically agreed in writing.
- Limitation of Liability: To the fullest extent permitted by law, the Company, its management, staff, shareholders, stakeholders, and affiliated entities shall not be liable for any loss, damage, injury, or disappointment suffered by any entrant or winner in connection with the competition, including but not limited to failure to receive prize components, cancellation, postponement, or modification of the competition.
- Fraud and Abuse: The Company reserves the right to disqualify any entrant found to have tampered with the entry process, acted dishonestly, or violated these terms. Legal action may be pursued against individuals found to have acted fraudulently.
- Modifications: The Company reserves the right to cancel, modify, or postpone any competition at any time and for any reason, including but not limited to circumstances beyond its reasonable control (force majeure), without liability to any entrant.
- Governing Law: These competition terms are governed by the laws of the Republic of South Africa. Any disputes arising from or related to competitions shall be subject to the exclusive jurisdiction of the South African courts.
- Personal Information: By entering a competition, entrants consent to the collection and processing of their personal information for the purpose of administering the competition, in accordance with the Protection of Personal Information Act (POPI), 2013. Winners may be required to participate in publicity activities relating to the prize, which may include the use of their name and image.
